The County Clerk of Berkeley County is responsible for recording and maintaining all records concerning the following:

  • Voter Registration
  • Hunting and Fishing Licenses
  • Document Recording
  • Justification of Surety
  • Birth Certificates
  • Marriage Licenses
  • Death Certificates
  • Minister's License
  • Marriage Certification

Schedule of Recording Fees

Deed (with OR without plat)
$10.00 for the first 5 pages, $1.00 for each additional page.
$1.00 for the first 1-9 pages, $1.00 for every 10 pages thereafter*

Deed of trust
$10.00 for the first 5 pages, $1.00 for the additional page.
$1.00 for the first 1-9 pages, $1.00 for every 10 pages thereafter*

Marriage License Information

  • No waiting period unless they are between the ages of 16 and 18 - then it is 3 days.
    No application will be issued under 15 years of age.
  • No blood test at all.
  • Need a form of identification with a full name & birth date on it (no initials). i.e., birth
    certificate, voter's registration card, driver's license. (Since 911, no one will accept
    anything with initials on it.)
  • Application is $36 in cash.
  • If they are residents of West Virginia, they have to apply in whatever county one of
    them lives in, but they can get married anywhere in the state of West Virginia. It
    cannot be taken to another state!!! However, if they are coming from out of state, they
    can apply anywhere in the state & get married anywhere within the state.
  • If they were married previously, a date of death or date of final divorce decree is
    necessary - month, date & year.
  • Application is only good for 60 days & is given to the couple at the time they apply.
  • They have to be married by a licensed minister (in the state of West Virginia) or a
    judge. There is no justice of the peace.
  • Applicants should arrive by 4:00 in orfer to allow sufficient time for the paperwork to be
    processed
